General terms and conditions

Article 1 Definitions

  1. Us: the natural or legal person offering products and/or services to consumers at a distance; in this case, GreenEggTotal.
  2. U: the natural person not acting in the exercise of a profession or business who enters into a distance contract with us.
  3. Remote agreement: an agreement exclusively or partly using means of distance communication.
  4. Remote communication technology: means such as telephone or internet that allow a contract to be concluded without you and us being physically present at the same time.
  5. Reflection period: the period within which you can exercise the right of withdrawal.
  6. Right of withdrawal: Your right to waive the contract within the cooling-off period.
  7. Day: calendar day.
  8. Duration transaction: a contract for a range of products, services or digital content, with delivery and/or purchase obligations spread over time.
  9. Durable data medium: a means by which you can store information and access it later, e.g. a USB stick.
  10. Digital content: data provided in digital form.

Article 3 Applicability

  1. These terms and conditions apply to any offer made by us and any distance contract concluded between you and us.
  2. The general terms and conditions will be made available prior to the conclusion of an agreement. If this is not possible, we will inform you where the terms and conditions can be found.
  3. Specific product or service conditions may additionally apply. In case of conflict, the most favourable provision for you prevails.

Article 4 Information

  1. Prior to purchase, we provide clear information about our products, services and digital content, including prices and terms and conditions.
  2. Delivery time: Orders placed on working days before 16:00 will be delivered the next day. If a product is not in stock, the delivery time may be longer. We will inform you in good time.
  3. Cancellation: You have the right to cancel an order as long as it has not been shipped. If the product has already been dispatched, it must be returned before we proceed with a refund.
  4. At the latest on delivery, you will receive information on:
    • Our visiting address and complaints procedure.
    • Your right of withdrawal and how to exercise it.
    • After-sales service and warranties.
    • The conditions for termination in duration transactions.
  5. If an item proves to be unavailable, you will be given the option to choose an alternative or cancel the order with the right to a refund.

Article 5 Confirmation and Security

  1. You will receive an electronic confirmation after placing an order. Until this has been done, you can waive the purchase.
  2. We secure data exchange and provide secure payment methods.
  3. Accepted payment methods include iDEAL, credit card, bank transfer and PayPal.

Article 6 Right of withdrawal

  1. Term: You have a 30-day cooling-off period after receiving the product.
  2. Return costs: Return costs are €4.50 for parcels and €95 for pallets. These costs are at your expense unless otherwise agreed.
  3. Conditions:
    • You should handle the product and packaging with care.
    • Returns should be made in original condition and packaging, if reasonably possible.
  4. Return process:
    • Report your return request via our return form on the website or by contacting our customer service team via e-mail.
    • After approval of the return, you will receive a return label that you can use to return the package.
    • Returns must be sent within 14 days of approval of the return.
  5. Reimbursement: We will refund all amounts paid by you, including standard delivery costs, within 14 days of receiving the returned product. We may wait to refund until receipt of the product or proof of shipment.
  6. Pallet shipments: Pallet shipments are handled by Koopman Transmission. These consignments cannot be dropped off at a standard parcel point and must be collected by appointment. Please contact our customer service.
  7. Transporters: Parcels are delivered by DHL, and pallet shipments are handled by Koopman Transmission. You will receive a tracking code as soon as the shipment is dispatched.
  8. If a product is out of stock, you will be notified. You have the right to cancel the order as long as it has not been shipped.
  9. Pallet shipments: Pallet shipments cannot be dropped off at a standard parcel point and must be collected by appointment. Please contact our customer service.

Article 7 Claims

  1. Please check your order for visible damage immediately upon receipt.
  2. Reporting deadline: Visible damage must be reported in writing within 7 days of receipt, preferably by e-mail with a clear picture of the damage so that we can check it. Non-visible defects must be reported within a reasonable period, not exceeding 2 months from discovery.
  3. This provision does not affect your legal rights.

Article 8 Exclusion of right of withdrawal

  1. The right of withdrawal does not apply to:
    • Products manufactured to your specifications.
    • Products that spoil quickly or have a limited shelf life.
    • Sealed products that are not suitable for return for health or hygiene reasons after breaking the seal.
    • Digital content that has not been delivered on a tangible medium and whose execution has begun with your consent.

Article 9 Liability

  1. We are only liable for direct damage caused by intent or gross negligence.
  2. We are not liable for indirect damages, such as consequential damages, lost profits or missed savings.
  3. Our liability is limited to the amount you paid for the product or service.
  4. We are not liable for damage caused by improper use of products, contrary to the manual or safety instructions.

Article 10 Complaints procedure

  1. Complaints should be reported within a reasonable time after discovery.
  2. We reply to complaints within 14 days of receipt. If more time is needed, we will inform you of the expected deadline.
  3. If a complaint cannot be resolved mutually, you can submit it to Qshops or the European ODR platform.

Article 11 Intellectual Property

All intellectual property rights relating to our products, services and website belong to us or our suppliers.

Article 12 Personal data

Your personal data will be processed in accordance with our privacy policy and the AVG.

Article 13 Force majeure

  1. We are not liable for delays or failures in the fulfilment of our obligations due to force majeure situations, such as natural disasters, pandemics, strikes, or technical failures.
  2. In case of force majeure, the obligations of both parties are suspended until the situation is resolved.

Article 14 Applicable law

All our agreements are exclusively governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.

Article 15 Workshops and Events

  1. Application: Registration for workshops and events can be done via our website or at one of our branches.
  2. Cancellation: If cancelled up to 48 hours before the start, you will receive a full refund. If cancelled within 48 hours of commencement, no refund will be made.
  3. Changes: We reserve the right to cancel or reschedule workshops in case of insufficient participation or unforeseen circumstances. In this case, you will be informed in good time and receive a refund of the amount paid.

Article 16 Gift vouchers

  1. Validity: Gift vouchers are valid for 1 year after issue unless otherwise stated.
  2. Redemption: Gift vouchers can be redeemed on our website or in our physical shops.
  3. Refund: Gift vouchers are not redeemable for cash and cannot be returned.

Article 17 Warranty and Repair

  1. Warranty period: We apply the manufacturer's warranty as stated with the relevant product.
  2. Repair: In case of defects within the warranty period, please contact our customer service for repair or replacement.
  3. Exclusions: The warranty does not cover damage caused by improper use, normal wear and tear or modifications made by the customer.

Article 18 Delivery terms

  1. Delivery area: We deliver in the Netherlands and Belgium.
  2. Shipping costs: Orders from €100 are shipped free of charge. Orders below this amount will be charged shipping costs, depending on weight and destination.
  3. Delivery time: Orders placed on working days before 16:00 will be shipped the same day. Delivery usually takes place within 1-2 working days.
  4. Collection: You have the option of collecting your order from one of our branches.
